TERMS AND CONDITIONS OF SALE

These Terms and Conditions govern the sale of products through MA GADGET, including its website magadget.fr.

By placing an order with MA GADGET, the customer acknowledges having read and accepted these Terms and Conditions.

1. Seller Information

MA GADGET sells new, used and refurbished electronic products, including smartphones, computers, tablets, accessories and other consumer electronics.

2. Products

Product photographs displayed on the MA GADGET website are provided for illustrative purposes. The actual product may vary slightly from the photograph shown, particularly with regard to color, appearance, packaging, accessories or other visual details.

Customers are advised to read the complete product description, specifications, condition and included accessories carefully before placing an order.

For used and refurbished products, photographs may not always represent the exact individual unit shipped. The product will, however, correspond to the condition, specifications and characteristics stated in its product description.

If there is any discrepancy between the product photograph and the written product description, the written product description and stated specifications shall prevail, subject to applicable consumer rights.

3. Prices

All prices displayed on the website are indicated in euros (€), unless otherwise stated.

MA GADGET reserves the right to modify prices at any time. The price applicable to an order is the price displayed at the time the order is placed.

4. Orders and Payment

An order is considered confirmed once payment has been successfully received and the customer has received an order confirmation.

MA GADGET may refuse or cancel an order in exceptional circumstances, including suspected fraud, payment problems, stock discrepancies or technical errors.

Available payment methods are displayed during the checkout process.

5. Delivery

Orders are shipped to the delivery address provided by the customer during checkout.

The customer is responsible for ensuring that the delivery information provided is accurate.

Delivery times are estimates and may be affected by circumstances outside MA GADGET's control, including carrier delays, strikes, weather conditions or other exceptional events.

Once the order has been handed over to the carrier, tracking information may be provided where available.

6. 15-Day Return Policy

MA GADGET offers a 15-day return policy from the date the customer receives the order.

To be eligible for a return:

  • The product must be returned within 15 days.

  • The product must be unused and unopened.

  • The product must be in its original condition.

  • Original packaging, accessories and included items must be returned.

  • The product must not show signs of use, damage or modification.

Products that have been opened, used, damaged, modified or altered may not be eligible for return under this commercial return policy.

The customer should contact MA GADGET before sending a product back.

Return shipping costs may be the responsibility of the customer unless the product is defective or the return is required by applicable law.

After receiving and inspecting the returned product, MA GADGET will process the applicable refund in accordance with the payment method and applicable legislation.

This commercial return policy does not limit any mandatory legal rights that consumers may have under French or European consumer protection law.

7. Used iPhone – 1-Month Replacement Guarantee

For used iPhones sold by MA GADGET, we provide a 1-month replacement guarantee covering hardware failures resulting from normal use.

If a qualifying hardware problem occurs within the first month following delivery, MA GADGET may, after inspection, replace the device with an equivalent device.

The replacement guarantee is subject to technical inspection by MA GADGET.

If an equivalent replacement device is unavailable, MA GADGET may propose an alternative solution, subject to applicable law.

8. 6-Month Service Warranty for Used iPhones

Used iPhones sold by MA GADGET also benefit from a 6-month service warranty covering hardware failures arising from normal use.

During this period, MA GADGET may, following inspection, repair the device where the problem is covered by the warranty.

The service warranty is intended to cover technical or hardware failures that occur during normal use.

The warranty does not guarantee that a device will remain completely free from defects for the entire warranty period.

9. Warranty Exclusions

The replacement guarantee and service warranty do not cover accidental or physical damage.

In particular, the warranty does not cover damage caused by:

  • Drops or impacts;

  • Cracked or broken screens;

  • Broken glass or housing;

  • Water, liquid or moisture damage;

  • Improper handling or misuse;

  • Pressure or crushing;

  • Unauthorized opening or repair;

  • Repairs or modifications performed by a third party;

  • Use of incompatible accessories or chargers where this causes damage;

  • Damage caused intentionally or through negligence;

  • Normal cosmetic wear and tear.

Battery capacity naturally decreases over time with normal use and may not be considered a hardware failure unless otherwise required by applicable law.

The warranty may also be refused where the device has been modified, tampered with or repaired by an unauthorized person.

10. Warranty Procedure

Before returning a device for warranty service, the customer must contact MA GADGET.

The customer may be asked to provide:

  • Order number;

  • Proof of purchase;

  • Description of the problem;

  • Photos or videos demonstrating the problem, where appropriate.

MA GADGET may perform a technical inspection before determining whether the issue is covered by the applicable guarantee or warranty.

If the issue is not covered, the customer may be informed of the available repair options and any associated costs before proceeding.

11. IMEI and Device Identification

For smartphones, including used iPhones, MA GADGET may record the device's IMEI, serial number or other identifying information at the time of sale.

This information may be used to verify the device and prevent fraudulent warranty or replacement claims.

The customer must return the same device originally purchased when making a warranty claim.

12. Data and Personal Information

Customers are responsible for backing up their personal data before returning a device for repair or replacement.

MA GADGET is not responsible for the loss of personal data stored on a device during testing, repair, replacement or reset.

Customers should remove their Apple ID, Google account, passwords, activation locks and other personal security measures before returning a device where applicable.

For iPhones, Find My iPhone / Activation Lock must be disabled before a warranty return can be processed.

13. Fraudulent or Abusive Warranty Claims

MA GADGET reserves the right to investigate suspected fraudulent or abusive warranty claims.

Examples may include:

  • Returning a different device;

  • Changing or removing the IMEI or serial number;

  • Attempting to claim warranty for intentional damage;

  • Providing false information;

  • Opening or modifying the device and subsequently requesting warranty service.

Such cases may result in the warranty claim being rejected, subject to applicable law.

14. Legal Consumer Rights

Nothing in these Terms and Conditions is intended to remove or restrict any mandatory rights granted to consumers under applicable French or European law.

Where applicable, consumers retain their statutory rights concerning legal conformity and hidden defects.

The commercial guarantees offered by MA GADGET are additional to, and do not replace, mandatory statutory consumer protections.

15. Limitation of Liability

MA GADGET shall not be responsible for indirect losses or damages resulting from the improper use of a product, except where liability cannot legally be excluded.

Customers are responsible for using products according to the manufacturer's instructions and applicable safety recommendations.

16. Intellectual Property

All content published on the MA GADGET website, including logos, photographs, graphics, text, product descriptions and branding, is protected by applicable intellectual property laws.

Reproduction or use of this content without prior authorization is prohibited.

17. Modification of Terms

MA GADGET reserves the right to update these Terms and Conditions when necessary.

The version applicable to an order is the version in force at the time the order is placed.

18. Applicable Law

These Terms and Conditions are governed by French law, subject to mandatory consumer protection provisions applicable to the customer.

In the event of a dispute, the customer and MA GADGET will first attempt to reach an amicable resolution.

Consumers retain their legal rights to use any applicable dispute-resolution or mediation mechanisms provided by French and European law.
